Surgery Unified, Inc. (“Company” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes:

  1. The types of information we may collect or that you may provide when you register with, access, or use SurgeOn (the “App”). The App may be accessed through a web browser on a computer, or as a mobile application downloaded from the Google Play Store or the Apple App Store for compatible mobile devices.
  2. Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect in this App and other electronic communications sent through or in connection with this App.

This policy DOES NOT apply to information that:

  1. We collect offline or on any other Company apps or websites, including websites you may access through this App.
  2. You provide to or is collected by any third party (see Third-Party Information Collection).
    Our other websites and apps, and these third parties, may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Note to users in Europe
The App is hosted in the United States. If you access and use this App in Europe, then your use constitutes your consent for us to collect, receive and process your personal information in the United States. The U.S. may not guarantee the same privacy protection as Europe. If you do not consent to processing in the U.S., then your choice is to not use this App. For further disclosures and rights, see Europe Privacy Disclosures – GDPR, below.

Information We Collect and How We Collect It

We collect information from and about users of our App (1) directly from you when you provide it to us, (2) indirectly through your use of the App, (3) through your connection of other account(s) with our App, and (4) automatically from the devices that you use to access the App. The term “personal information” refers to any of the above if it can be traced to you individually, to your device, or to your household.

It is your choice to provide us your personal information. You are not obligated by law or contract to use the App or provide us with your personal information, which you may decline to do by choosing not to use this App. Some or all of the App functionality may require you to provide certain pieces of personal information necessary to provide you the functionality you are trying to use. Certain technical browser data is collected automatically and is required for you to use the App. If you do not provide the required personal information, then we may be unable to provide you with expected functionality, and we will have no liability or responsibility to you as a result of your choice.

  1. Information You Provide to Us
    1. When you download this App and register an account with us to use it, we may ask you to provide information:
      • By which you may be personally identified, such as name, email address, National Provider Identification Number, and any other identifier by which you may be contacted online or offline.
      • About you, your background, and any other information we request, such as type of surgeon or workplace.
    2. After you register, we continue to collect information that you provide, including:
      • Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App.
      • Material that you input into the App, including posts, comments, messages, videos, and photos (“User Content”). Your User Content is posted and transmitted to others at your own risk, and you acknowledge that we cannot control the actions of third parties with whom you share your User Content, including providing them to unauthorized persons.
      • Information that you provide when you report a problem with the App.
      • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
      • Your search queries on the App.
  2. Information from Your Use of the App
    We also collect information when you use the features and functionality of our App. This may include:
    1. Your interactions with posts or other content and users who are also using the App, including “likes” or other reactions, re-posts, bookmarks, and your use of any other features or functionality of the App.
    2. A record of the content that you interact with.
    3. Inferences about your interests.
    4. Information stored on or made available by your device when you grant access permissions, including your contacts, photo gallery, camera and microphone access, geolocation data (coarse and fine), and phone and text functions.
  3. Information from Your Connected Account(s)
    We partner with other companies in the healthcare industry to provide enhanced experience for our App users. This may include the option to use your account at other companies to log into the SurgeOn App or link your SurgeOn App account with your account at other companies. If you choose to proceed with one of the options above, your profile information will be collected by our Company. This Privacy Policy applies to your profile information acquired by us.
  4. Automatic Information Collection
    When you download, access, and use the App, it may use technology to automatically collect:
    1. Usage Details. When you access and use the App, we may automatically collect certain technical information, including traffic data, location data, logs, and other communication data, and the resources that you access and use on or through the App.
    2. Technical Usage Information. Information about your device and internet connection, including your IP address, operating system, browser type, and certain device or browser settings such as time zone and language.
    3. Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device that you upload to the App.

Tracking Technologies

We use standard internet technologies, such as cookies and web beacons, that collect information about your use of our App. These technologies may allow third-party partners, including advertising platforms, to receive information about your activity on our App, which may include the content and videos that you view. By continuing to use this App, you consent to the use of all such technologies as set forth herein. If you do not want us to collect this information, then your choice is to not download or use the App, and to delete it from all of your devices.

The technologies we use for automatic information collection may include:

  1. Cookies. A cookie is a small file placed on your smartphone, tablet or computer browser. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of our App.
  2. Web Beacons. Pages of the App may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages, used those resources, and for other related app statistics (such as recording the popularity of certain app content and verifying system and server integrity).

Legal Basis of Collection

For users of our App in the European Union (EU) or the European Economic Area (EEA), we collect your personal information pursuant to one or more of the following legal bases:

  1. Consent: Your use of the App constitutes your express consent to our collection and processing of your personal information for the purposes described in this Privacy Policy. If you do not consent, then you may not use the App. You may revoke your consent by contacting us. If you revoke consent, then you are no longer authorized to use the App, and we may immediately deactivate your account and delete your data and information without any notice or responsibility to you.
  2. Providing the Service: Processing your personal information is necessary in order for us to provide you the features and functionality that you expect from this App.
  3. Legal Obligations: We may be required to collect and process certain personal information to comply with our legal obligations.
  4. Legitimate Interests: We may determine that the collection and processing of certain personal information is necessary for our legitimate interests that are not overridden by your interests.

Third-Party Information Collection

  1. When you use the App or its content, certain third parties may use automatic information collection technologies to collect or infer information about you or your device. These third parties may include:
    1. Advertisers, ad networks, and ad servers.
    2. Analytics companies.
    3. Your mobile device manufacturer.
    4. Your mobile service provider.
  2. These third parties may use tracking technologies to collect information about you when you use this App, which may include making inferences about what types of advertisements or content may be of interest to you. The information they collect may be associated with your personal information or they may collect information, including more personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. If you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target audience criteria and associate those criteria with unique third party trackers and advertising identifiers that are in common use across the internet and on mobile devices.

    We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

  1. We use information that we collect about you or that you provide to us, including any personal information, to:
    1. Provide you with the App and its contents, and any other information, products or services that you request from us.
    2. Fulfill any other purpose for which you provide it.
    3. Notify you when App updates are available, and of changes to any products or services we offer or provide through it.
    4. Provide you with notices about your account (if any), and to notify you about changes to the App.
    5. Fulfill any other purpose that we notify you about when you provide personal information, which may be purposes in addition to those disclosed in this privacy policy.
    6. Answer your questions and inquiries, respond to your requests, and investigate situations that you raise to us.
    7. To fulfill our legal obligations, which may include reviewing requests to remove copyrighted material.
  2. The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:
    1. Estimate our audience size and usage patterns.
    2. Store information about your preferences, allowing us to customize our App according to your individual interests.
    3. Speed up your searches.
    4. Recognize you when you use the App.
    5. Administer the App, troubleshoot errors, and support the security and functionality of the App.
  3. In addition, we may anonymize and de-identify the information you provide us in a manner that it can no longer be reasonably linked to you individually. Once we anonymize or de-identify the information, it is no longer subject to this privacy policy because it is no longer personal information.

    We have not disclosed personal information as defined by the California “Shine the Light” law to third parties for their direct marketing purposes in the past year. Disclosure of Your Information

  1. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. Within our organization, we may make your information available to our directors, officers and employees.

    In addition, we may disclose personal information that we collect or you provide under the following circumstances:
    1. With your consent.
    2. To fulfill the purpose for which you provide it.
    3. For any other purpose disclosed by us when you provide the information.
    4. To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
    5. To enforce our rights arising from any contracts entered into between you and us, including the App terms of use, and for billing and collection.
    6. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Surgery Unified, Inc., our customers or others.
  2. We may disclose your information to the following categories of recipients without your consent:
    1. To our subsidiaries and affiliates.
    2. To contractors, service providers, professional advisers, and other third parties we use to support our business.
    3. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Surgery Unified, Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Surgery Unified, Inc. about our App users is among the assets transferred.

Links to Outside Websites and Services

If you are using our App and click on a link to any website or other app that we do not control or operate, you will leave our App and land on a page or in an app provided by a third party. At that point, we have no control over, and will not be responsible for, any privacy practices or data collection or use of any third party. Before providing your personal information to any such third party, we encourage you to review their privacy notice or policy.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. If you have questions about our collection, use and disclosure of your information or would like certain information to be deleted and/or not disclosed, please contact us at info@surgeryunified.com

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the App, visiting your account profile page, and using the functionality that we provide on that profile page.

You may also send us an email at info@surgeryunified.com to request access to, correction, or deletion of any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Content from the App, copies of your User Content may remain viewable in cached and archived pages, or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Content, may also be governed by our terms of use.

Account Deletion; Retention Period

We store your data until it is no longer necessary to provide our services, or until your account is deleted — whichever comes first. When you delete your account, we delete all media and text you have posted, which is not recoverable. Information that others have shared about you isn’t part of your account and won’t be deleted. The account deletion process may take up to 30 business days to complete.

In some cases, to establish or meet our legal rights or obligations, or for other legitimate business purposes, we may retain certain personal information for a longer period.

Data Security

Although we have implemented certain measures intended to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure, the transmission and exchange of information via the internet and mobile platforms is not completely secure. Use of any internet-connected service including the App comes with inherent risks that your personal information may be exposed, lost, altered, or accessed without authorization. Although we use commercially reasonable efforts to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App like message boards. The information you share in public areas may be viewed by any user of the App.

Europe Privacy Disclosures – GDPR

If you are in the European Union or the European Economic Area (“Europe” for purposes of this section) when you provide us your personal information, then this section applies to that information. The disclosures and rights in this section may not apply to other personal information that we collect and/or process when you are not in Europe.

YOUR RIGHTS & PREFERENCES AS A DATA SUBJECT Subject to the GDPR and applicable law’s limitations, the rights afforded to you as a data subject are:

  1. RIGHT TO BE INFORMED
    You have a right to be informed about the manner in which any of your personal data is collected or used which we have endeavored to do by way of this Policy.
  2. RIGHT OF ACCESS
    You have a right to access the personal data you have provided by requesting us to provide you with the same.
  3. RIGHT TO RECTIFICATION
    You have a right to request us to amend or update your personal data if it is inaccurate or incomplete.
  4. RIGHT TO ERASURE
    You have a right to request us to delete your personal data.
  5. RIGHT TO RESTRICT
    You have a right to request us to temporarily or permanently stop processing all or some of your personal data.
  6. RIGHT TO OBJECT
    You have a right, at any time, to object to our processing of your personal data under certain circumstances.
    You have an absolute right to object to us processing your personal data for the purposes of direct marketing.
  7. RIGHT TO DATA PORTABILITY
    You have a right to request us to provide you with a copy of your personal data in electronic format and you can transmit that personal data for using another third-party’s product/service.
  8. RIGHT NOT TO BE SUBJECT TO AUTOMATED DECISION-MAKING
    You have a right to not be subject to a decision based solely on automated decision making, including profiling.
  9. Transmission of Personal Information to the United States
    We operate out of the United States. To provide you the App when you are in Europe, we require your consent to collect and store your information in the United States. By interacting with us while you are in Europe, you consent to our collection of your information and to the transmission of your personal data to the United States for storage and processing consistent with the purposes for which you provided us your data. If you do not consent, or if you revoke your consent, laws may require us to delete your account and data permanently. We are obligated to inform you that in the United States, you may have more difficulty exercising rights about your data than in Europe, and there is no supervisory authority protecting your privacy in the U.S. as there is in your country within Europe.
  10. Data Subject Rights
    With respect to your personal information collected while you are in Europe, you have the rights, among others, to:
    1. Request that we (1) give you access to your information; (2) permit you to object to our processing of your information; (3) rectify (correct) or (4) erase your information upon your request; (5) restrict our processing of your data for profiling, marketing or automated decision-making (if we do any of these); or (6) provide a portable version of your data, if required by applicable law in each case.
    2. Withdraw all or any consents for us to use your information. Please note that even if you withdraw consent, applicable law may permit us to retain some or all of your personal data if another legitimate basis is available to do so and if we have continued business need for such data.
    3. Lodge a complaint against us and our use of your personal information with the applicable supervisory authority, which is a regulatory body in the European Union member country where you live, work or where you believe we misused your information.
  11. Automated Decision Making
    We do not engage in automated decision making using your personal information.
    1. Not for Children or Minors Under the Age of 18
      The App is not intended for children and minors under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child or minor under 18, please contact us using the information provided at the end of this privacy policy.
    2. Changes to Our Privacy Policy
      We may update this privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page, and we may choose to notify you by email to the email address specified in your account, by a notification viewable in the App, or by any other means we believe is reasonable. If you continue using the App after this privacy policy is updated, then you agree to the modified terms.The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
